1. Scope

These General Terms and Conditions of Sale (hereinafter "GTC") govern all sales made on the website
www.gustcarepro.com , under the brand name Gust Care Pro , exclusively to professional clients (hereinafter "the Client").

Any order placed on the site implies full and complete acceptance of these Terms and Conditions, to the exclusion of all other conditions, including those of the Customer.

3. Products

The products offered are intended exclusively for professional use (groomers, veterinarians, breeders, shelters, pet shops, canine centers and specialized structures).

Gust Care Pro markets, among other things, shampoos for dogs, formulated without perfume , designed to respect the skin, skin balance and animal welfare, regardless of the size or type of coat of the animal.

The products offered are not veterinary medicines and are in no way a substitute for veterinary diagnosis, advice or treatment.

Gust Care Pro reserves the right to modify the product range, formulations, packaging or characteristics at any time, without incurring any liability.

4. Orders

Orders are placed exclusively online via the website www.gustcarepro.com .

They only become final after payment validation and confirmation by Gust Care Pro.

The Client guarantees the accuracy of the information provided when placing the order, in particular regarding their professional status and VAT number.
Gust Care Pro reserves the right to refuse or cancel any order in the event of a prior dispute, non-payment, incorrect information or abnormal request.

5. Price – VAT – Payment Terms

Prices are expressed in euros (€), excluding taxes (HT) .

VAT is applied in accordance with current Belgian and European legislation :

• For business customers established in Belgium , Belgian VAT is charged.
• For business customers established in another Member State of the European Union , with a valid intra-community VAT number , VAT is self-assessed , in accordance with Article 138 of Directive 2006/112/EC.
• For customers established outside the European Union , sales may be exempt from VAT, subject to compliance with applicable legal conditions.

Delivery costs are shown before final order confirmation.

Payments can be made by credit card, bank transfer or any other payment method offered on the site.

In the event of deferred payment granted to the Client, any delay in payment may result in the application of penalties in accordance with applicable legislation.

6. Delivery times and conditions

Orders are usually shipped within 48 to 72 business hours after confirmation.

Delivery times are given as an indication only and are estimated between 7 and 10 working days , depending on the destination and the carrier.

A tracking number is provided to the Customer when it is available.

Deliveries are made in accordance with the Incoterm DAP (Delivered At Place – EU) , unless otherwise agreed in writing.

No delivery delay can justify cancellation of the order or a claim for damages.

7. Receiving the goods

The Customer is required to check the condition of the goods upon receipt.

In the event of damage, loss or shortage, the Customer must make specific reservations on the delivery note and confirm them in writing to the carrier within 48 hours , with a copy sent to Gust Care Pro.

Otherwise, the goods will be deemed to be in conformity and no claim will be accepted.

8. No right of withdrawal

In accordance with European legislation, as sales are made exclusively between professionals , no right of withdrawal applicable to consumers applies .

9. Liability and guarantees

Gust Care Pro guarantees that the products conform to the descriptions on the website.

Any claim relating to a defect must be made in writing within 7 days of delivery.

Gust Care Pro's liability is strictly limited, at its option, to replacing the product recognized as defective or refunding the price paid , excluding any other compensation.

It is the Client's responsibility to verify the suitability of the products ordered for the intended use and the specific needs of the animals.
Gust Care Pro declines all responsibility in case of use not in accordance with the recommendations.

10. Retention of Title

The delivered goods remain the property of Gust Care Pro until full payment of the price, principal and accessories.

11. Force majeure

Gust Care Pro cannot be held responsible for any delay or failure to perform resulting from a case of force majeure, including in particular: strikes, natural disasters, fires, floods, health crises, supply disruptions or logistical disruptions.

12. Applicable Law and Jurisdiction

These terms and conditions are governed by Belgian law .

Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of Brussels .

The language of interpretation of these Terms and Conditions is French . In the event of a translation, only the French version shall prevail.
